The rights of a Hindu female in property of Hindu male dying intestate (without Will) are governed by Section 8 of Hindu Succession Act, 1956. The Act has categorized the relatives as Class I and Class II. The property firstly devolves upon the heirs of class-I on relatives. In the absence of any relatives specified in Class I, the property will devolve on relatives listed in Class II. In the absence of Class I & II relatives, the agnates come into picture, and thereafter cognates. Each class of relatives includes both male and female members. Mother is a Class-I heir and Father is Class-II heir.
