Hindus had well established legal system of joint family property, where members of different generations lived in harmony sharing common roof, common food. The Hindu Succession Act 1956 retains certain features of old system. According to Section 23 of Hindu Succession Act, any female heir cannot force partition of the dwelling unit inherited, if such dwelling unit is wholly occupied by the members of deceased Hindu; until the male heirs in occupation of house prefer partition. However, female heirs have right of residence. In case, female heir is a daughter, she is entitled to the residence only if she is unmarried, has been deserted or separated from her husband or is a widow.
